Article 1 – Seller

The products offered on lucky-deals.shop (the “Site”) are sold by Wall Agency, a limited liability company (LLC) registered in the State of New Mexico, United States, EIN 88-1182923, registered office 530-B Harkle Road STE 100, Santa Fe, NM 87505, United States, operating the Lucky Deals brand (the “Seller”).

Article 2 – Scope

These terms of sale apply to sales concluded on the Site between the Seller and any individual acting for non-professional purposes (the “Customer”). The Customer accepts them when placing an order. The applicable version is the one online on the day of the order; the Customer can save and print it.

Article 3 – Products

The essential characteristics of each product (function, materials, dimensions, sizes, instructions for use) are shown on its product page. Lifestyle photos and videos are illustrative and not contractual. Products are available while stocks last.

Article 4 – Prices, bundles and strikethrough prices

Prices are shown in euros, including VAT where applicable. Shipping fees, if any, are shown before payment (see our Shipping policy); the total displayed before you confirm payment is final.

Bundle offers (“1+1”: 2 identical items, “2+1”: 3 identical items) are sold at the bundle price shown on the product page; the second or third item is not free, it is included in the bundle price.

A strikethrough price shown next to a single item is a price at which the same product is sold by another retailer, checked on the date indicated in our records. A strikethrough price shown next to a bundle is the corresponding number of items at that reference price, or at our own single-item price. The percentage shown is the difference between these two prices.

Discount codes (for example a code won with the scratch ticket) apply under the conditions shown with the code, cannot be combined unless stated, and are applied in the cart or at checkout. The scratch ticket is free and requires no purchase.

The price charged is the one displayed when the order is confirmed.

Article 5 – Ordering

The Customer selects products and adds them to the cart, enters contact details and delivery address, chooses the delivery method, checks the summary (products, prices, fees, total) and can correct any error. The order is confirmed by clicking the payment button, which implies an obligation to pay. The contract is concluded once payment is validated. The Seller sends an order confirmation by email without delay. The Seller may refuse an order in case of a previous payment dispute or suspected fraud.

Article 6 – Payment

The price is payable in full when ordering, using the payment methods offered at checkout. Payments are processed by secure providers; the Seller never has access to your full card details.

Article 7 – Delivery

Products are delivered to the address given by the Customer, in the countries offered at checkout. Orders ship within 24 hours on business days; transit takes 4 to 7 business days to Europe and 7 to 12 business days to the rest of the world. The estimated date is shown before ordering and in the confirmation. Without a stated date, delivery takes place at the latest 30 days after the order (article L.216-1 of the French Consumer Code). The risk of loss or damage passes to the Customer when they physically take possession of the products (article L.216-4). In case of delay, the Customer has the rights provided by articles L.216-6 and L.216-7. Details are in our Shipping policy.

Article 8 – Right of withdrawal and 30-day returns

Period. In accordance with articles L.221-18 and following of the French Consumer Code, the Customer has 14 days from receipt of the products to withdraw, without giving any reason. As a commercial gesture, the Seller extends this period to 30 days from delivery. When several products are delivered separately, the period starts on receipt of the last product.

How to withdraw. The Customer informs the Seller of the decision before the period ends: online, via the Withdraw from contract link at the bottom of every page of the Site, without creating an account, by entering their name, order number and email and clicking “Confirm withdrawal” (an acknowledgement is sent by email); or by any unambiguous statement sent to gatsbird@gmail.com or by post to the customer service address, for example using the model form in our Refund policy.

Returning the products. The Customer sends the products back to Wall Agency — Lucky Deals, 71 rue Jean de Bernardy, 13001 Marseille, France at the latest 14 days after communicating the decision. Return costs are paid by the Customer. The Customer is only liable for any loss of value resulting from handling other than what is needed to establish the nature, characteristics and functioning of the products.

Refund. The Seller refunds all sums paid, including standard delivery fees when the whole order is returned, at the latest 14 days after being informed of the withdrawal, using the same payment method as the order unless the Customer expressly agrees otherwise, at no cost to the Customer. The Seller may delay the refund until the products are received or until the Customer provides proof of shipment, whichever comes first. For a partial return of a bundle, the refund equals the price actually paid for the returned items, calculated from the bundle price.

Article 9 – Legal guarantees

The Seller is bound by the legal guarantee of conformity (articles L.217-3 and following of the French Consumer Code) and the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code). To use them, the Customer contacts customer service at gatsbird@gmail.com; return costs are then paid by the Seller.

The consumer has two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer only has to establish the existence of the lack of conformity and not its date of appearance. The legal guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience. If the goods are repaired under the legal guarantee, the consumer benefits from a six-month extension of the initial guarantee. If the consumer asks for repair but the seller imposes replacement, the legal guarantee is renewed for two years from the date of replacement.

The consumer may obtain a price reduction while keeping the goods, or end the contract and be fully refunded against return of the goods, if: 1° the seller refuses to repair or replace the goods; 2° repair or replacement takes place after thirty days; 3° repair or replacement causes a major inconvenience for the consumer; 4° the lack of conformity persists despite the seller's unsuccessful attempt to remedy it. The consumer is also entitled to a price reduction or termination of the contract when the lack of conformity is so serious that it justifies immediate price reduction or termination. The consumer is not entitled to terminate the sale if the lack of conformity is minor. Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee until the goods are returned.

These rights result from articles L.217-1 to L.217-32 of the French Consumer Code. A seller who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (article L.241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee gives the right to a price reduction if the goods are kept or a full refund against return of the goods.

Article 10 – Customer reviews

Reviews shown on the Site may come from the platforms of our suppliers, where they were posted by buyers of the same product. They are translated into English, published with their original rating and without any compensation. Their origin is shown next to the reviews.

Article 11 – Personal data

Customer data is processed in accordance with our Privacy policy.

Article 12 – Customer service and mediation

For any complaint, the Customer first contacts customer service at gatsbird@gmail.com. If the dispute is not resolved, the Customer may use the consumer mediator free of charge, within one year of the written complaint to the Seller (articles L.612-1 and following of the French Consumer Code): CNPM – Médiation de la consommation, 27 avenue de la Libération, 42400 Saint-Chamond, France — cnpm-mediation-consommation.eu.

Article 13 – Applicable law and courts

These terms of sale are governed by French law. This choice does not deprive the Customer of the protection granted by the mandatory provisions of the law of their country of residence. In case of dispute, the Customer may bring the matter before the court of the place where they lived when the contract was concluded or where the damage occurred.
